ROCKLIN, CA - A candidate for El Dorado County district attorney contacted at his Placer County townhouse insists he only stays there on weekends to spend time with his 7-year-old son.
"I live in Placerville," said Judson Henry, 52, a bankruptcy attorney who filed papers March 9 to unseat District Attorney Vern Pierson, who has not faced opposition before.
On his declaration of candidacy form, Henry listed a home address at 6556 Mother Lode Drive in Placerville, a house owned by political consultant Cristofer Alarcon and shared by Alarcon's wife, Sherilyn.
Property records show the house has just two bedrooms, one bathroom and is not quite 1,200 square feet in size.
Placerville bail bondsman and political activist Chuck Holland assigned two private investigators to track Henry's movements and plans to file a lawsuit in El Dorado County Superior Court to have him disqualified from the June ballot because of the residency issue.
"I have concrete proof that his residence is not in El Dorado County," Holland said.
One of Holland's investigators snapped a picture of Henry outside the Rocklin townhouse on March 10, and another has been watching the house in Placerville.
"They keep pretty close tabs, and it seems Mr. Henry's car never shows up there," Holland said.
Henry answered the door at the Rocklin townhouse around noon on Monday and said the fact that he was there, as he was the previous Monday at noon, proved nothing. Henry's wife, Susan, and their son were inside.
Update March 20, 2014: Susan Henry contacted News10 to say the couple are divorced. "He has not resided in my home in Rocklin for quite some time. Jud is an amazing father and willing to do anything for his son's sense of security," she wrote in an email.
"I come here at least once a week to visit my boy," he said. "You can camp out here, probably sometime next weekend on Saturday or Sunday, and you'll find me here again. And the weekend after that, and the weekend after that."
Until last week, the State Bar of California listed the townhouse on Brookside Circle as Henry's address. The database has since been updated to show an office address in Shingle Springs, which is in El Dorado County.
Pierson claims El Dorado County Supervisor Ray Nutting, who faces trial next month on fraud charges, recruited Henry to run against Pierson as payback.
Cristofer Alarcon, who provided the Placerville address for Henry, has worked on Nutting's campaigns and Nutting gathered nominating signatures for Henry, but Nutting denies any deeper involvement.
Henry said he was running against Pierson only because he believes the district attorney has abused his position.
"I'm not Ray Nutting's puppet," Henry insisted.
